Chapitre 1er. Principes constitutionnels

Article 2

L’autorité publique doit oeuvrer pour faire des idées démocratiques un principe directeur dans tous les domaines de la société et veiller à la sauvegarde de la vie privée et familiale des personnes. Elle doit promouvoir la possibilité pour tous d’accéder à la participation et à l’égalité dans la société. Elle doit combattre la discrimination fondée sur le sexe, la couleur, les origines nationales ou ethniques, la langue, l’appartenance religieuse, le handicap, l’orientation sexuelle, l’âge ou toute autre circonstance affectant l’individu en tant que personne.
Les possibilités pour les minorités ethniques, linguistiques et religieuses de conserver et de développer leur propre vie culturelle et sociale doivent être favorisées.

Chapitre 2. Droits et libertés fondamentaux

Article 1er

Tout citoyen est assuré à l’égard de l’autorité publique :

6. de la liberté de religion : liberté de pratiquer sa religion, individuellement ou en commun.

Article 2

Tout citoyen est, à l’égard de l’autorité publique, protégé contre l’obligation de révéler son opinion en matière politique, religieuse, culturelle ou autre. Il est également protégé à l’égard de l’autorité publique contre l’obligation de prendre part à une réunion visant à agir sur l’opinion, à une manifestation ou autre forme d’expression des opinions, ou d’appartenir à un groupement politique, une communauté religieuse ou tout autre groupement d’opinion tel que visé à la première phrase.

Article 12

Les droits et libertés visés aux points 1 à 5 de l’article premier ainsi qu’aux articles 6 et 8 et au second alinéa de l’article 11 peuvent, dans la mesure prévue aux articles 13 à 16, être restreints par une loi. Après habilitation donnée par une loi, ils peuvent être restreints par un autre acte législatif ou réglementaire dans les cas visés au premier alinéa, point 7, de l’article 7 et à l’article 10 du chapitre VIII. Les libertés de réunion et de manifestation peuvent également être restreintes selon les mêmes modalités dans les cas visés au premier alinéa, deuxième phrase, de l’article 14.
Les restrictions visées au premier alinéa ne peuvent intervenir que pour répondre à des fins admissibles dans une société démocratique. Elles ne doivent jamais aller au-delà de ce qui est nécessaire au regard des objectifs qui les motivent, ni prendre une ampleur telle qu’elle menace la liberté de l’opinion en tant que l’un des fondements du régime démocratique. Aucune restriction ne peut intervenir sur la seule base d’une opinion politique, religieuse, culturelle ou analogue.

Article 13

La liberté d’expression et la liberté d’information peuvent être restreintes en considération de la sécurité nationale, de l’approvisionnement de la population, de l’ordre et de la sécurité publics, de la réputation des personnes et du respect de la vie privée, ou de la prévention et de la répression des infractions. La liberté d’expression peut par ailleurs être restreinte dans les activités économiques. D’autres restrictions ne peuvent être apportées aux libertés d’expression et d’information que si des motifs particulièrement importants le justifient.
Pour juger des restrictions permises en application du premier alinéa, il est tenu compte tout particulièrement de l’importance d’une liberté d’expression et d’information aussi large que possible dans les domaines politique, religieux, syndical, scientifique et culturel.

Article 22

Tout ressortissant étranger se trouvant en Suède est assimilé à un citoyen suédois en ce qui concerne :
1. la protection contre l’obligation de prendre part à une réunion visant à agir sur l’opinion, à une manifestation ou autre forme d’expression des opinions, ou d’appartenir à une communauté religieuse ou tout autre groupement (deuxième phrase de l’article 2);

Sous réserve de dispositions législatives particulières, tout ressortissant étranger se trouvant en Suède est également assimilé à un citoyen suédois en ce qui concerne :
1. la liberté d’expression, la liberté d’information, la liberté de réunion, la liberté de manifestation, la liberté d’association et la liberté de religion (article premier);

Chapitre 8. Lois et autres règlements

Article 6

Les dispositions relatives aux communautés religieuses sont fixées par la loi. La loi fixe également des dispositions sur les fondements de l’Eglise de Suède en tant que communauté religieuse.
Pour l’adoption, la modification ou l’abrogation d’une telle loi, il est fait application des dispositions de l’article 16 sur l’adoption du Règlement du Riksdag.

Chapitre 11. Justice et administration

Article 6

Des attributions administratives peuvent être déléguées à des sociétés, des associations, des communautés, des fondations, des communautés religieuses enregistrées ou l’une de leurs unités organisationnelles, ou à des personnes physiques. Les attributions appliquant l’exercice de l’autorité publique doivent être déléguées en vertu de la loi.

Chapter 1. Basic principles of the form of government

Article 2

The public institutions shall promote the ideals of democracy as guidelines in all sectors of society and protect the private and family lives of private persons. The public institutions shall promote the opportunity for all to attain participation and equality in society. The public institutions shall combat discrimination of persons on grounds of sex, colour, national or ethnic origin, linguistic or religious affiliation, functional disability, sexual orientation, age or other circumstance affecting the private individual as a person.
Opportunities should be promoted for ethnic, linguistic and religious minorities to preserve and develop a cultural and social life of their own.

Chapter 2. Fundamental rights and freedoms

Article 1

Every citizen shall be guaranteed the following rights and freedoms in his relations with the public institutions:

6.freedom of worship: that is, the freedom to practise one’s religion either alone or in the company of others.

Article 2

Every citizen shall be protected in his relations with the public institutions against any coercion to divulge an opinion in any political, religious, cultural or other such connection. He shall further be protected in his relations with the public institutions against any coercion to participate in a meeting for the formation of opinion or a demonstration or other manifestation of opinion, or belong to a political association, religious community or other association for the manifestation of opinion referred to in sentence one.

Article 12

The rights and freedoms referred to in Article 1, points 1 to 5, in Articles 6 and 8, and in Article 11, paragraph two, may be restricted in an act of law to the extent provided for in Articles 13 to 16. With authority in law, they may be restricted by statutory instrument in cases under Chapter 8, Article 7, paragraph one, point 7, and Article 10. Freedom of assembly and freedom to demonstrate may be similarly restricted also in cases under Article 14, paragraph one, sentence two.
The restraints referred to in paragraph one may be imposed only to satisfy a purpose acceptable in a democratic society. The restraint must never go beyond what is necessary having regard to the purpose which occasioned it, nor may it be carried so far as to constitute a threat to the free formation of opinion as one of the fundaments of democracy. No restraint may be im-posed solely on grounds of a political, religious, cultural or other such opinion.

Article 13

Freedom of expression and freedom of information may be restricted having regard to the security of the Realm, the national supply of goods, public order and public safety, the integrity of the individual, the sanctity of private life, and the prevention and prosecution of crime. Freedom of expression may also be restricted in commercial activities. Freedom of expression and freedom of information may otherwise be restricted only where particularly important grounds so warrant.
In judging what restrictions may be introduced by virtue of paragraph one, particular regard shall be paid to the importance of the widest possible freedom of expression and freedom of information in political, religious, professional, scientific and cultural matters.

Article 22

A foreign national within the Realm shall be equated with a Swedish citizen in respect of :
1.protection against any coercion to participate in a meeting for the formation of opinion or a demonstration or other manifestation of opinion, or to belong to a religious community or other association (Article 2, sentence two);

Unless it follows otherwise from special provisions of law, a foreign national within the Realm shall be equated with a Swedish citizen also in respect of :
1.freedom of expression, freedom of information, freedom of assembly, freedom to demonstrate, freedom of association, and freedom of worship (Article 1);

Chapter 8. Acts of law and other provisions

Article 6

Provisions concerning religious communities shall be laid down in an act of law. Provisions concerning the bases of the Church of Sweden as a religious community shall also be laid down in an act of law.
The enactment, amendment or abrogation of such an act of law shall be governed by the provisions of

Article 16 concerning enactment of the Riksdag Act.

Chapter 11. Administration of justice and general administration

Article 6

(...)
Administrative functions may be delegated to a limited company, association, collective, foundation, registered religious community or any part of its organisation, or to a private person. If such a function involves the exercise of public authority, delegation shall be made by virtue of law.


Transitional provisions relating to Act no 1974:152

14. This Instrument of Government in no way alters the provisions laid down in Article 2 of the previous Instrument of Government.1. 1. 1 kap. Statsskickets grunder

2 §

Det allmänna skall verka för att demokratins idéer blir vägledande inom samhällets alla områden samt värna den enskildes privatliv och familjeliv. Det allmänna skall verka för att alla människor skall kunna uppnå delaktighet och jämlikhet i samhället. Det allmänna skall motverka diskriminering av människor på grund av kön, hudfärg, nationellt eller etniskt ursprung, språklig eller religiös tillhörighet, funktionshinder, sexuell läggning, ålder eller annan omständighet som gäller den enskilde som person.
Etniska, språkliga och religiösa minoriteters möjligheter att behålla och utveckla ett eget kultur- och samfundsliv bör främjas.

2 kap. Grundläggande fri- och rättigheter

1 §

Varje medborgare är gentemot det allmänna tillförsäkrad :

6.religionsfrihet: frihet att ensam eller tillsammans med andra utöva sin religion.

2 §

Varje medborgare är gentemot det allmänna skyddad mot tvång att giva till känna sin åskådning i politiskt, religiöst, kulturellt eller annat sådant hänseende. Han är därjämte gentemot det allmänna skyddad mot tvång att deltaga i sammankomst för opinionsbildning eller i demonstration eller annan meningsyttring eller att tillhöra politisk sammanslutning, trossamfund eller annan sammanslutning för åskådning som avses i första meningen.

12 §

De fri- och rättigheter som avses i 1 § 1-5 samt i 6 och 8 §§ och i 11 § andra stycket får, i den utsträckning som 13-16 §§ medgiver, begränsas genom lag. Efter bemyndigande i lag får de begränsas genom annan författning i de fall som anges i 8 kap. 7 § första stycket 7 och 10 §. I samma ordning får mötesfriheten och demonstrationsfriheten begränsas även i de fall som anges i 14 § första stycket andra meningen.
Begränsning som avses i första stycket får göras endast för att tillgodose ändamål som är godtagbart i ett demokratiskt samhälle. Begränsningen får aldrig gå utöver vad som är nödvändigt med hänsyn till det ändamål som har föranlett den och ej heller sträcka sig så långt att den utgör ett hot mot den fria åsiktsbildningen såsom en av folkstyrelsens grundvalar. Begränsning får ej göras enbart på grund av politisk, religiös, kulturell eller annan sådan åskådning.

13 §

Yttrandefriheten och informationsfriheten får begränsas med hänsyn till rikets säkerhet, folkförsörjningen, allmän ordning och säkerhet, enskilds anseende, privatlivets helgd eller förebyggandet och beivrandet av brott. Vidare får friheten att yttra sig i näringsverksamhet begränsas. I övrigt får begränsningar av yttrandefriheten och informationsfriheten ske endast om särskilt viktiga skäl föranleder det.
Vid bedömandet av vilka begränsningar som får ske med stöd av första stycket skall särskilt beaktas vikten av vidaste möjliga yttrandefrihet och informationsfrihet i politiska, religiösa, fackliga, vetenskapliga och kulturella angelägenheter.

22 §

Utlänning här i riket är likställd med svensk medborgare i fråga om :
1. skydd mot tvång att deltaga i sammankomst för opinionsbildning eller i demonstration eller annan meningsyttring eller att tillhöra trossamfund eller annan sammanslutning (2 § andra meningen);

Om annat icke följer av särskilda föreskrifter i lag, är utlänning här i riket likställd med svensk medborgare även i fråga om :
1. yttrandefrihet, informationsfrihet, mötesfrihet, demonstrationsfrihet, föreningsfrihet och religionsfrihet (1 §) ;

8 kap. Lagar och andra föreskrifter

6 §

Föreskrifter om trossamfund meddelas i lag. I lag skall också meddelas föreskrifter om grunderna för Svenska kyrkan som trossamfund.
Vid stiftande, ändring eller upphävande av sådan lag gäller vad som sägs i 16 § om stiftande av riksdagsordningen.

11 kap. Rättskipning och förvaltning

6 §

(...)
Förvaltningsuppgift kan överlämnas till bolag, förening, samfällighet, stiftelse, registrerat trossamfund eller någon av dess organisatoriska delar eller till enskild individ. Innefattar uppgiften myndighetsutövning, skall det ske med stöd av lag.


Övergångsbestämmelser 1974:152

Genom denna regeringsform görs ej ändring i vad som hittills har gällt enligt 2 § i den äldre regeringsformen.1 1Regeringsformen (1809) - §2 Konungen skall alltid vara af den rena evangeliska läran, sådan som den uti den oförändrade Augsburgiska bekännelsen samt Upsala mötes beslut af år 1593 antagen och förklarad är.
