L’unité du peuple et l’égalité des citoyens

Article 4

1. L’Etat a pour fondement l’unité du peuple roumain et la solidarité de ses citoyens.
2. La Roumanie est la patrie commune et indivisible de tous ses citoyens, sans distinction de race, de nationalité, d’origine ethnique, de langue, de religion, de sexe, d’opinion, d’appartenance politique, de fortune ou d’origine sociale.

Le droit à l’identité

Article 6

1. L’Etat reconnaît et garantit aux personnes appartenant aux minorités nationales le droit de conserver, de développer et d’exprimer leur identité ethnique, culturelle, linguistique et religieuse.
2. Les mesures de protection prises par l’Etat pour la conservation, le développement et l’expression de l’identité des personnes appartenant aux minorités nationales, doivent être conformes aux principes d’égalité et de non-discrimination par rapport aux autres citoyens roumains.

Les Roumains de l’étranger

Article 7

L’Etat soutient le resserrement des liens avec les Roumains vivant au-delà des frontières du pays et agit pour préserver, développer et exprimer leur identité ethnique, culturelle, linguistique et religieuse, en respectant la législation de l’Etat dont ils sont les citoyens.

La liberté de conscience

Article 29

1. La liberté de pensée et d’opinion, ainsi que la liberté de religion ne peuvent être limitées sous aucune forme. Nul ne peut être contraint à adopter une opinion ou à adhérer à une religion qui soient contraires à ses convictions.
2. La liberté de conscience est garantie; elle doit se manifester dans un esprit de tolérance et de respect réciproque.
3. Les cultes religieux sont libres et ils s’organisent conformément à leurs propres statuts, dans les conditions fixées par la loi.
4. Dans les relations entre les cultes, toutes formes, tous moyens, actes ou actions de discorde religieuse sont interdits.
5. Les cultes religieux sont autonomes par rapport à l’Etat et jouissent de son soutien, y compris par les facilités accordées pour donner une assistance religieuse dans l’armée, dans les hôpitaux, dans les établissements pénitentiaires, dans les asiles et dans les orphelinats.
6. Les parents ou les tuteurs ont le droit d’assurer, en accord avec leurs propres convictions, l’éducation des enfants mineurs dont la responsabilité leur incombe.

Le droit à l’instruction

Article 32

1. Le droit à l’instruction est assuré par l’enseignement général obligatoire, par l’enseignement secondaire et par l’enseignement professionnel, par l’enseignement supérieur, ainsi que par d’autres formes d’instruction et de perfectionnement.
2. L’enseignement de tous les degrés est dispensé en roumain. Dans les conditions prévues par la loi, l’enseignement peut être dispensé dans une langue de communication internationale.
3. Le droit des personnes appartenant aux minorités nationales d’apprendre leur langue maternelle et le droit de pouvoir être instruites dans cette langue sont garantis; les modalités de l’exercice de ces droits sont déterminées par la loi.
4. L’enseignement public est gratuit, conformément à la loi. L’Etat accorde des bourses sociales d’études aux enfants et aux jeunes provenant des familles démunies et à ceux institutionnalisés, dans les conditions établies par la loi.
5. L’enseignement de tous les degrés se déroule dans les institutions de l’Etat, privées et confessionnelles, dans les conditions prévues par la loi.
6. L’autonomie universitaire est garantie.
7. L’Etat assure la liberté de l’enseignement religieux, conformément aux nécessités spécifiques de chaque culte. Dans les écoles publiques, l’enseignement religieux est organisé et garanti par la loi.

La famille

Article 48

1. La famille est fondée sur le mariage librement consenti entre les conjoints, sur leur égalité et sur le droit et le devoir des parents d’assurer la croissance, l’éducation et l’instruction des enfants.
2. Les conditions de conclusion, dissolution et annulation du mariage sont fixées par la loi. Le mariage religieux ne peut être célébré qu’après le mariage civil.
3. Les enfants sont égaux devant la loi, qu’ils soient nés d’un mariage ou hors mariage.

La validation du mandat et la prestation du serment

Article 82

1. Le résultat des élections à la fonction de Président de la Roumanie est validé par la Cour constitutionnelle.
2. Le candidat dont l’élection a été validée prête devant la Chambre des Députés et le Sénat, réunis en séance commune, le serment suivant: "Je jure de consacrer toute ma force et toutes mes capacités à la prospérité spirituelle et matérielle du peuple roumain, de respecter la Constitution et les lois du pays, de défendre la démocratie, les droits fondamentaux et les libertés fondamentales des citoyens, la souveraineté, l’indépendance, l’unité et l’intégrité territoriale de la Roumanie. Que Dieu m’y aide!"

Unity of the people and equality among citizens

Article 4

1. The State foundation is laid on the unity of the Romanian people and the solidarity of its citizens.
2. Romania is the common and indivisible homeland of all its citizens, without any discrimination on account of race, nationality, ethnic origin, language, religion, sex, opinion, political adherence, property or social origin.

Right to identity

Article 6

1. The State recognizes and guarantees the right of persons belonging to national minorities to the preservation, development and expression of their ethnic, cultural, linguistic and religious identity.
2. The protection measures taken by the Romanian State for the preservation, development and expression of identity of the persons belonging to national minorities shall conform to the principles of equality and non-discrimination in relation to the other Romanian citizens.

Romanians living abroad

Article 7

The State shall support the strengthening of links with the Romanians living abroad and shall act accordingly for the preservation, development and expression of their ethnic, cultural, linguistic and religious identity, with the observance of the legislation of the State whose citizens they are.

Freedom of conscience

Article 29

1. Freedom of thought, opinion, and religious beliefs shall not be restricted in any form whatsoever. No one shall be compelled to embrace an opinion or religion contrary to his own convictions.
2. Freedom of conscience is guaranteed; it must be manifested in a spirit of tolerance and mutual respect.
3. All religions shall be free and organized in accordance with their own statutes, under the terms laid down by law.
4. Any forms, means, acts or actions of religious enmity shall be prohibited in the relationships among the cults.
5. Religious cults shall be autonomous from the State and shall enjoy support from it, including the facilitation of religious assistance in the army, in hospitals, prisons, homes and orphanages.
6. Parents or legal tutors have the right to ensure, in accordance with their own convictions, the education of the minor children whose responsibility devolves on them.

Right to education

Article 32

1. The right to education is provided by the compulsory general education, by education in high schools and vocational schools, by higher education, as well as other forms of instruction and postgraduate improvement.
2. Education at all levels shall be carried out in Romanian. Education may also be carried out in a foreign language of international use, under the terms laid down by law.
3. The right of persons belonging to national minorities to learn their mother tongue, and their right to be educated in this language are guaranteed; the ways to exercise these rights shall be regulated by law.
4. State education shall be free, according to the law. The State shall grant social scholarships to children or young people coming from disadvantaged families and to those institutionalized, as stipulated by the law.
5. Education at all levels shall take place in state, private, or confessional institutions, according to the law.
6. The autonomy of the Universities is guaranteed.
7. The State shall ensure the freedom of religious education, in accordance with the specific requirements of each religious cult. In public schools, religious education is organized and guaranteed by law.

Family

Article 48

1. The family is founded on the freely consented marriage of the spouses, their full equality, as well as the right and duty of the parents to ensure the upbringing, education and instruction of their children.
2. The terms for entering into marriage dissolution and nullity of marriage shall be established by law. Religious wedding may be celebrated only after the civil marriage.
3. Children born out of wedlock are equal before the law with those born in wedlock.

Validation of mandate and oath-taking

Article 82

1. The election returns for the Presidency of Romania shall be validated by the Constitutional Court.
2. The candidate whose election has been validated shall take before the Chamber of Deputies and the Senate, in a joint sitting, the following oath: "I solemnly swear that I will dedicate all my strength and the best of my ability for the spiritual and material welfare of the Romanian people, to abide by the Constitution and laws of the country, to defend democracy, the fundamental rights and freedoms of my fellow-citizens, Romania’s sovereignty, independence, unity and territorial integrity. So help me God!"
