Accord du 8 novembre 2000 entre le Saint Siège et la République de Lettonie

Le Saint Siège et la République de Lettonie,
En tenant compte qu’en 1922 a été signé entre le Saint Siège et la République de Lettonie un concordat qui aujourd’hui, à la lumière des changements survenus au niveau national aussi bien qu’au niveau international, doit être remplacé par un nouvel accord international ;
En tenant compte, pour le Saint Siège, des documents du Concile Vatican II et des normes du droit canonique et, pour la République de Lettonie, des principes établis dans sa Constitution et dans les conventions internationales auxquelles elle adhère ;
En prenant conscience du fait qu’une part importante de la population de la République de Lettonie professe la religion catholique ;
En reconnaissant la contribution positive proposée par l’Église catholique au développement religieux et moral, à la réhabilitation et à la réintégration sociale de la République de Lettonie ;
En souhaitant définir le statut juridique de l’Église catholique, régulariser la collaboration dans le domaine de l’enseignement et de la culture et promouvoir de manière stable et appropriée l’assistance religieuse aux membres catholiques des forces armées nationales et aux catholiques détenus en prison ;
ont convenu de ce qui suit :

I. Le statut juridique de l’Église catholique

1. La personnalité juridique de l’Église catholique

Article 1

Le Saint Siège et la République de Lettonie reconnaissent être indépendants et autonomes, chacun dans ses sphères de compétence. Ils réaffirment le respect de ce principe concernant les services que chacune des parties entend promouvoir, soit individuellement, soit conjointement, pour favoriser le développement spirituel et matériel de la société lettone.

Article 2

1. La République de Lettonie reconnaît la personnalité juridique publique de l’Église catholique en Lettonie.
2. Les institutions de l’Église catholique dans la République de Lettonie qui, conformément au droit canonique, ont le statut de personnes juridiques publiques, jouissent également de la personnalité juridique en droit civil conformément à la législation de la République de Lettonie.
3. L’autorité ecclésiastique compétente peut – conformément aux normes canoniques correspondantes – établir, modifier, reconnaître et supprimer des personnes juridiques publiques ecclésiastiques. Dans le cas où ces changements modifieraient la situation actuelle de l’Église catholique dans la République de Lettonie, ils seront communiqués aux autorités civiles compétentes, conformément à la législation actuelle de la République de Lettonie.

Article 3

La République de Lettonie reconnaît le droit de l’Église catholique, des personnes juridiques qui en dépendent et de chaque catholique, de communiquer librement et d’avoir des contacts avec le Saint Siège et les autres institutions ecclésiastiques reconnues par le droit canonique, y compris celles qui sont situées en dehors du pays.

Article 4

En ce qui concerne la liberté religieuse consacrée par la législation de la République de Lettonie et par les accords internationaux auxquels la République de Lettonie a adhéré, est garantie à l’Église catholique de la République de Lettonie, ainsi qu’à ses communautés et institutions, la liberté de choisir son gouvernement interne, de célébrer le culte et de remplir sa mission par des activités pastorales, y compris celles de nature sociale, éducative et culturelle.

Article 5

La nomination, le transfert et la révocation des évêques est de la compétence exclusive du Saint Siège. L’office épiscopal sera confié uniquement à des prêtres de nationalité lettone. Avant la publication de la nomination d’un évêque diocésain, le Saint Siège informera le Président de la République de Lettonie en bonne et due forme.

Article 6

1. La République de Lettonie garantit l’inviolabilité de tous les lieux de culte, lesquels ne peuvent être utilisés à d’autres fins sans l’accord préalable des autorités ecclésiastiques compétentes.
2. À la demande de l’autorité ecclésiastique, les autorités civiles compétentes ou leurs représentants peuvent intervenir en cas d’urgence, dans le cas où l’ordre public est gravement menacé ou afin d’éviter des dommages graves pour les personnes ou les biens d’une valeur artistique ou culturelle particulière. Une telle demande peut être présumée dans le cas où des raisons urgentes témoignent en faveur d’une intervention immédiate, dans l’objectif de limiter les risques pour l’ordre public et les dommages pour les personnes ou les choses.

Article 7

L’inviolabilité du secret du sacrement de la réconciliation est reconnue. Personne ne peut jamais interroger un prêtre catholique sur des sujets liés au secret de la confession, même dans le cas où le prêtre doit comparaître comme témoin ou comme partie en cause devant un tribunal civil.

Article 8

1. À partir de sa célébration, le mariage canonique produit les effets civils déterminés par la législation de la République de Lettonie, à condition qu’il n’existe aucun obstacle civil entre les parties au contrat et que les conditions prévues par la législation de la République de Lettonie soient respectées.
2. La procédure et la période d’enregistement d’un mariage canonique auprès de l’autorité civile compétente sont établies par la législation de la République de Lettonie.

Article 9

Dans le respect de la législation de la République de Lettonie et en vue de ses activités pastorales légitimes, il est garanti à l’Église catholique ce qui suit :
a) La liberté d’accès aux moyens de communication sociale et la liberté de parole, y compris la création de ses propres moyens de communication sociale et l’accès à ceux de l’État, conformément à la législation de la République de Lettonie;
b) La liberté d’association des fidèles visant à promouvoir des initiatives sociales, culturelles ou éducatives inspirées par les principes de la foi chrétienne, par la doctrine sociale de l’Église catholique et en conformité avec les principes de l’oecuménisme.
c) L’accès aux hôpitaux, prisons, orphelinats et à toutes les autres institutions d’assistance sociale ou médicale, dans lesquelles la présence de catholiques justifie la présence pastorale, occasionnelle ou permanente, des représentants autorisés de l’Église catholique.

Article 10

La République de Lettonie garantit à l’Église catholique la restitution des biens soustraits de manière illégale, conformément à la législation de la République de Lettonie, moyennant un commun accord entre les autorités compétentes de l’État et la Conférence épiscopale de Lettonie.

2. Le sanctuaire d’Aglona

Article 11

1. Le sanctuaire d’Aglona fait partie intégrante du patrimoine culturel et historique de la République de Lettonie et en tant que tel il est protégé par les normes juridiques existantes de la République de Lettonie.
2. Outre l’édifice de la basilique, la place devant la basilique et le cimetière, et la zone de la fontaine, le territoire protégé du sanctuaire comprend tous les autres bâtiments, structures et terrains qui appartiennent à l’Église catholique.

Article 12

1. En considération du caractère international du sanctuaire d’Aglona comme lieu de prière, destination de pèlerinage et siège de diverses activités pastorales, et en tenant compte de la législation actuelle, la République de Lettonie s’engage à :
a) reconnaître et respecter le caractère religieux et historique du sanctuaire ;
b) garantir l’ordre public pendant les assemblées prévues dans le programme des évènements visés à l’article 13, sur la base des accords passés avec l’évêque local ou avec les autres membres de la Conférence épiscopale de Lettonie ;
c) contribuer aux frais de maintenance du sanctuaire en rapport avec les évènements d’importance nationale ;
d) accorder une dispense des taxes, ou une réduction de celles-ci, dans les cas prévus par la loi.
2. Pour sa part, le Saint Siège reconnaît au sanctuaire d’Aglona le statut de « sanctuaire international », comme le prévoit le droit canonique (CIC, can. 1231 et s.).

Article 13

Tous les ans, avant la rédaction du budget de l’État, l’Église catholique soumet au Conseil des ministres une liste des évènements programmés pour l’année suivante qui pourraient avoir une importance nationale. En accord avec les autorités locales, le Conseil des ministres adopte les mesures nécessaires pour garantir l’ordre public et pour faire face aux besoins médicaux et sanitaires.

II. L’Église catholique et les institutions éducatives

1. L’enseignement de la religion catholique dans les écoles

Article 14

La République de Lettonie reconnaît le droit des parents et de leurs représentants légaux et, dans les cas prévus par la loi, des enfants eux-mêmes, d’assurer à leurs enfants une éducation religieuse appropriée grâce à des cours de religion dans les écoles publiques et communales et à des classes de catéchisme le dimanche. L’État garantit ce droit dans les termes fixés par la loi et par les traités internationaux signés par la République de Lettonie.

Article 15

L’enseignement de la religion catholique est donné exclusivement sur la base d’un programme approuvé par la Conférence épiscopale de Lettonie, en accord avec le Ministère de l’éducation et de la science, et est dispensé uniquement par des enseignants qualifiés en possession d’un certificat de compétence délivré par la Conférence épiscopale de Lettonie ; la révocation du certificat entraîne la privation immédiate du droit d’enseigner la religion catholique.

Article 16

Conformément à la législation de la République de Lettonie, l’Église catholique a le droit de fonder des instituts d’enseignement supérieur pour les enseignants de religion, délivrant des diplômes civilement reconnus.

Article 17

Les autorités de l’État de la République de Lettonie et l’Église catholique veilleront, chacune dans le cadre de sa compétence, à faire en sorte que l’enseignement de la religion catholique dans les institutions éducatives soit donné avec la compétence académique et doctrinale exigée et en prêtant attention à la promotion de l’esprit oecuménique, du respect réciproque entre les différentes confessions religieuses et de l’égalité de tous.

2. Les écoles catholiques

Article 18

1. L’Église catholique a le droit d’établir et de diriger des écoles de tout ordre et niveau, conformément à la législation de la République de Lettonie et aux normes du droit canonique.
2. L’établissement d’écoles catholiques est demandé par la Conférence épiscopale de Lettonie au nom de l’ordinaire local.
3. Les écoles catholiques ainsi que les instituts d’enseignement supérieur observent les lois de la République de Lettonie en matière de normes générales relatives au curriculum national, à l’administration et à la délivrance des diplômes civilement reconnus.

Article 19

1. Les écoles catholiques ont droit à un soutien financier, conformément à la législation de la République de Lettonie.
2. Les enseignants et autres employés des écoles catholiques officiellement reconnues, ainsi que les élèves et leurs parents, ont les mêmes droits et devoirs que leurs homologues des écoles publiques et communales.

3. Le grand séminaire de Riga

Article 20

1. Le grand séminaire de Riga est une institution de l’Église catholique en Lettonie pour la formation académique des étudiants ecclésiastiques et pour les études de théologie catholique.
2. La reconnaissance du grand séminaire de Riga comme institut d’enseignement supérieur est accordée par l’État conformément à la loi.
3. Les diplômes et les cours du grand séminaire de Riga, conformes à la législation et aux normes civiles, sont considérés comme valides et équivalents à ceux des institutions éducatives de l’État.
4. Dans le cadre de la loi, l’État accorde une aide économique au grand séminaire de Riga dans la même mesure que pour les autres institutions équivalentes.

4. La Faculté de théologie catholique auprès de l’Université de Lettonie

Article 21

Le rétablissement de la Faculté de théologie catholique au sein de l’Université de Lettonie sera négocié entre le Saint Siège et le gouvernement de la République de Lettonie dans un second temps.

5. Le patrimoine culturel et artistique de l’Église catholique

Article 22

1. Le patrimoine culturel et artistique de l’Église catholique constitue une part importante du patrimoine national de la République de Lettonie. La République de Lettonie et l’Église catholique s’engagent d’un commun accord à en assurer la conservation et l’entretien et à le rendre accessible au public, dans les limites imposées par sa sauvegarde et par la législation internationale.
2. En conformité avec la loi, l’État partagera avec l’Église catholique les frais nécessaires à la maintenance et à la sauvegarde du patrimoine culturel et artistique de l’Église catholique.

III. Assistance religieuse aux catholiques présents dans les forces armées nationales de la République de Lettonie

Article 23

Le Saint Siège établira au sein de l’Église catholique de la République de Lettonie un ordinariat militaire qui garantira l’assistance religieuse aux catholiques présents dans les forces armées nationales de Lettonie, conformément à un mémorandum d’entente spécifique entre le Ministère de la défense et la Conférence épiscopale de Lettonie.
2. Cet ordinariat militaire, équivalent à un diocèse du point de vue canonique selon la constitution apostolique Spiritualis militum curae, sera présidé par un évêque ordinaire militaire.

Article 24

1. L’ordinaire militaire, qui doit être un citoyen letton, peut occuper simultanément la fonction d’évêque diocésain ou auxiliaire.
2. L’ordinaire militaire est librement nommé par le pontife romain et la nomination est communiquée préalablement à la République de Lettonie.

Article 25

1. La République de Lettonie garantit aux membres catholiques des forces armées nationales la possibilité de recevoir une instruction catéchistique appropriée et de participer aux célébrations eucharistiques ainsi qu’aux jours de fête, si cela ne s’oppose pas au déroulement de devoirs militaires officiels urgents.
2. Conformément aux normes canoniques, l’ordinaire militaire nomme un vicaire général et, après consultation des autorités compétentes des forces armées nationales, désigne un nombre adapté d’aumôniers militaires de nationalité lettone qui peuvent être incardinés dans l’ordinariat militaire. Ils sont considérés comme équivalents à des curés ou des aumôniers de paroisse.

Article 26

Les étudiants du grand séminaire de Riga et les novices des congrégations religieuses sont exemptés du service militaire et peuvent être assignés à un service communautaire équivalent au service militaire obligatoire. En cas de mobilisation générale, ces étudiants et novices sont assignés à des opérations qui n’impliquent pas l’usage des armes.

Article 27

Conformément aux normes canoniques, les personnes soumises à la juridiction de l’ordinariat militaire sont les suivantes :
a) le personnel militaire et civil catholique des forces armées nationales de la République de Lettonie ;
b) les membres de leurs familles, épouses et enfants, y compris les enfants catholiques qui appartiennent au même noyau familial.

Article 28

1. Les aumôniers et leurs assistants soumis à l’autorité canonique militaire, exercent leur service pastoral conformément aux normes relatives aux temps et aux lieux des activités pastorales et aux autres conditions générales qui émanent des autorités des forces armées nationales.
2. L’ordinariat militaire coordonne ses activités avec le Ministère de la défense.

Article 29

Le Ministère de la défense pourvoit à l’assistance matérielle du personnel de l’ordinariat militaire, conformément à la législation de la République de Lettonie, ainsi qu’aux besoins logistiques des activités pastorales.

IV. Assistance religieuse aux fidèles catholiques détenus dans les prisons de la République de Lettonie

Article 30

1. Conformément à l’article 9 c) du présent accord, l’Église catholique a le droit de fournir une assistance religieuse aux catholiques détenus dans les prisons et dans les autres institutions de détention analogues.
2. Conformément à la législation de la République de Lettonie et aux normes du droit canonique, l’autorité compétente garantit aux prisonniers le droit à une assistance religieuse appropriée.

V. Dispositions finales

Article 31

1. Le Saint Siège et la République de Lettonie résoudront d’un commun accord et de manière diplomatique tout doute ou difficulté pouvant résulter de l’interprétation ou de l’application du présent accord.
2. Les détails relatifs à certains aspects spécifiques de cet accord seront réglés grâce à des documents d’entente particuliers entre les autorités compétentes de l’Église catholique et de la République de Lettonie.

Article 32

Si le Saint Siège et la République de Lettonie pensent que des amendements sont nécessairesà la lumière de changements importants survenus après la conclusion de cet accord, des négociations appropriées seront engagées par le nonce apostolique d’une part, et des représentants du gouvernement letton d’autre part.

Article 33

Le présent accord est soumis à ratification selon les normes constitutionnelles et de procédure du Saint Siège et de la République de Lettonie et entrera en vigueur à la date de l’échange des documents de ratification.

Agreement between the Republic of Latvia and the Holy See of 8 November 2000

The Republic of Latvia and the Holy See, Considering that in 1922 a Concordat was signed between the Republic of Latvia and the Holy See, which, given the changes that have occurred at both the national and international levels, should be now replaced by a new international Agreement;
Taking into consideration, on the part of the Republic of Latvia, the principles enshrined in its Constitution and in the International Conventions to which it adheres, and, on the part of the Holy See, the documents of the Second Vatican Council and the norms of Canon Law;
Aware that an important part of the population of the Republic of Latvia professes the Catholic Religion; Acknowledging the positive contribution of the Catholic Church within the Republic of Latvia to the religious and moral development, the social rehabilitation and reintegration of the Nation;
Wishing to define the juridical status of the Catholic Church, to regulate collaboration in the areas of education and culture and to promote in a stable and appropriate manner religious assistance to the Catholic members of the National Armed Forces and to the Catholics being held in prison;
have agreed the following by common accord:

Part I. The juridical status of the Catholic Church

Section 1. The juridical personality of the Catholic Church

Article 1

The Republic of Latvia and the Holy See recognize that they are both, within their proper spheres of competence, independent and autonomous. They reaffirm their respect for this principle with regard to the services by which each party, both individually and jointly, intends to promote the greater spiritual and material development of Latvian society.

Article 2

1. The Republic of Latvia recognizes the public juridical personality of the Catholic Church in Latvia.
2. The institutions of the Catholic Church in the Republic of Latvia, which in accordance with Canon Law have the status of public juridical persons, shall also enjoy juridical personality in civil law, according to the legislation of the Republic of Latvia.
3. The competent ecclesiastical authority may - in accordance with the pertinent canonical norms - establish, modify, recognize and suppress ecclesiastical juridical public persons. In the case that such changes should affect the existing situation of the Catholic Church in the Republic of Latvia, they shall be communicated to the competent civil authorities, in accordance with the existing legislation of the Republic of Latvia.

Article 3

The Republic of Latvia recognizes the right of the Catholic Church, of the juridical persons dependent upon it, and of individual Catholics to communicate freely and maintain contacts with the Holy See and the other ecclesiastical institutions recognised by Canon Law, including those outside the Country.

Article 4

As regards freedom of religion, sanctioned by the legislation of the Republic of Latvia and the international agreements to which the Republic of Latvia has adhered, the Catholic Church in the Republic of Latvia, together with its communities and institutions, shall be guaranteed freedom to determine its internal government, to worship and to accomplish its mission through pastoral activities, including those of a social, educational and cultural nature.

Article 5

The nomination, transfer and removal of Bishops is the exclusive right of the Holy See. The office of Bishop shall be conferred only on priests who are Latvian citizens. Before the publication of the appointment of a diocesan Bishop, the Holy See will, out of courtesy and in confidence, inform the President of the Republic of Latvia.

Article 6

1. The Republic of Latvia guarantees the inviolability of all places of worship which may not be used for other purposes without the prior agreement of the competent ecclesiastical authorities.
2. At the request of the ecclesiastical authority, the competent civil authorities or their representatives may intervene in case of emergency, if public order is being gravely threatened, or in order to avoid grave harm to persons or damage to items of particular historical or artistic value. Such a request may be presumed should urgent reasons favour an immediate intervention, in order to limit danger to public order and damage to persons or property.

Article 7

The seal of the sacrament of confession is recognised as inviolable. Nobody may ever question a Catholic priest on matters connected with a confessional secret, even if that priest should appear as a witness or party before a civil tribunal.

Article 8

1. From the moment of its celebration canonical marriage produces the civil effects determined by the legislation of the Republic of Latvia, provided no civil impediments exist between the contracting parties and the requisites foreseen by the laws of the Republic of Latvia have been fulfilled.
2. The way and the time within which a canonical marriage is to be registered with the competent civil authority are determined by the laws of the Republic of Latvia.

Article 9

With respect to the laws of the Republic of Latvia and in view of its legitimate pastoral undertakings, to the Catholic Church shall be guaranteed:
(a) freedom of access to the media and freedom of speech, including the establishment of its own means of social communication and access to those of the State, in accordance with the legislation of the Republic of Latvia;
(b) freedom of association of the faithful, in order to promote social, cultural or educational initiatives inspired by the principles of the Christian faith, the social doctrine of the Catholic Church and according to the principles of ecumenism;
(c) access to hospitals, prisons, orphanages and all other institutions of social or medical assistance, in which the presence of Catholics justifies the occasional or permanent pastoral presence of the authorised representatives of the Catholic Church.

Article 10

The Republic of Latvia guarantees to the Catholic Church the restoration of unlawfully alienated property, in accordance with the legislation of the Republic of Latvia through a common accord between the competent State Authorities and the Bishops‘ Conference of Latvia.

Section 2. The Shrine of Aglona

Article 11

1. The Shrine of Aglona is part of the cultural and historical heritage of the Republic of Latvia, and as such is protected under existing legal provisions of Latvia.
2. Besides the building of the Basilica itself, the sacred square in front of the Basilica and the cemetery, the spring area, the territory protected within the Shrine shall include all other buildings, structures and lands belonging to the Catholic Church.

Article 12

1. In consideration of the international character of shrine of Aglona as a place for prayer, pilgrimage and various pastoral activities, and keeping in mind the existing legislation, the Republic of Latvia assumes the duty:
(a) to recognise and respect the religious and historical character of the Shrine;
(b) to guarantee public order during the gatherings included in the schedule of events referred to in Article 13, as agreed either with the local Bishop himself or with the other members of the Bishops’ Conference of Latvia;
(c) to contribute towards the maintenance costs of the Shrine in relation to events of national significance;
(d) to grant exemption from or the reductions of taxes in the circumstances foreseen by the laws.
2. For its part, the Holy See shall grant the Shrine of Aglona the status of an “international shrine”, as foreseen in Canon Law (cf. can. 1231 ff.)

Article 13

Each year, before the State budget is drawn up, the Catholic Church shall provide the Cabinet of Ministers with a plan of the events scheduled for the following year which could be of national significance. In agreement with the local authorities, the Cabinet of Ministers shall adopt the measures necessary to meet the requirements of public order and the medical and sanitary needs.

Part II. The Catholic Church and institutions of education

Section 1. The teaching of the Catholic religion in schools

Article 14

The Republic of Latvia recognises the right of parents and their legal representatives, and, in the cases provided for by law, of children themselves, to ensure for their children an adequate religious education in institutes of education through religion classes in State and municipal schools, and the Catholic Sunday schools. The State guarantees this right within the terms established by law and the international treaties binding upon the Republic of Latvia.

Article 15

The teaching of the Catholic religion shall be conducted exclusively on the basis of a programme approved by the Bishops’ Conference of Latvia, in agreement with the Ministry of Education and Science, and shall be undertaken only by qualified teachers who possess a certificate of competence issued by the Bishops’ Conference of Latvia; the revocation of which signifies the immediate loss of the right to teach the Catholic religion.

Article 16

In conformity with the legislation of the Republic of Latvia, the Catholic Church has the right to found institutions of higher formation for teachers of religion which will grant civilly recognized diplomas.

Article 17

The State authorities of the Republic of Latvia and the Catholic Church will strive, each within its own competence, to ensure that the teaching of the Catholic religion in educational establishments is undertaken with due academic and doctrinal competence, and with concern for the promotion of an ecumenical spirit, reciprocal respect between different religious confessions and equality for all.

Section 2. Catholic Schools

Article 18

1. The Catholic Church has the right to establish and manage schools at every level, in conformity with the laws of the Republic of Latvia and the norms of Canon Law.
2. The foundation of Catholic Schools shall be requested by the Bishops’ Conference of Latvia the latter acting on behalf of the local Ordinary.
3. Catholic Schools, as well as institutions of higher formation, shall observe the laws of the Republic of Latvia concerning the general norms relating to the national curriculum, to their management and the granting of civilly recognised diplomas.

Article 19

1. Catholic Schools are entitled to financial support, in accordance with the laws of the Republic of Latvia.
2. Teachers and other employees in officially recognised Catholic Schools, as well as students and their parents, shall enjoy the same rights and have the same obligations as their counterparts in State and local government schools.

Section 3. The Major Seminary of Riga

Article 20

1. The Major Seminary of Riga is an institution of the Catholic Church in Latvia for the academic formation of ecclestiastic students and the study of catholic theology.
2. Recognition of the Major Seminary of Riga, as an institution of higher education will be granted by the State in accordance with the law.
3. The diplomas and courses of study of the Major Seminary of Riga - which conform to civil laws and regulations, will be considered valid and equivalent to those of the educational institutions of the State.
4. Within the framework of the law, the State will grant economic assistance to the Major Seminary of Riga to the same extent as it does to other equivalent institutes.

Section 4.The Faculty of Catholic Theology at the University of Latvia

Article 21

The Reinstatement of the Faculty of Catholic Theology within the University of Latvia will be negotiated in the future between the Holy See and the Government of the Republic of Latvia.

Section 5. The cultural and artistic heritage of the Catholic Church

Article 22

1. The cultural and artistic heritage of the Catholic Church is to be considered as an important part of the national heritage of the Republic of Latvia. The Republic of Latvia and the Catholic Church assume, by common accord, the duty to ensure its maintenance and care, and to make it accessible to the public, within the limits required for its safe custody and by international law.
2. In accordance with the law, the State will share with the Catholic Church in meeting the cost of cultural and artistic heritage of the Catholic Church.

Part III. Religious assistance to the Catholics in the national armed forces of the Republic of Latvia

Article 23

1. The Holy See shall establish within the Catholic Church in the Republic of Latvia a Military Ordinarate which, according to a special memorandum of understanding between the Ministry of Defence and the Bishops’ Conference of Latvia, shall offer religious assistance to the Catholics within the National Armed Forces of the Republic of Latvia.
2. This Military Ordinariate, which is, according to the Apostolic Constitution Spiritualis militum curae, canonically equivalent to a diocese, will be headed by a Bishop Military Ordinary.

Article 24

1. The Military Ordinary, who shall be a Latvian citizen, may at the same time hold the office of a diocesan or auxiliary Bishop.
2. The Military Ordinary will be freely nominated by the Supreme Pontiff, and the President of the Republic of Latvia will be given prior notification of the appointment.

Article 25

1. The Republic of Latvia shall guarantee to the Catholic members of the National Armed Forces the possibility of receiving adequate catechetical instruction and of participating in Eucharistic Celebrations on Sundays and on Holidays of obligation, provided these do not conflict with urgent official military duties.
2. In conformity with canonical norms, the Military Ordinary will nominate a Vicar General and, in consultation with the competent authority within the National Armed Forces, will designate an appropriate number of Military Chaplains of Latvian citizenship, who may be incardinated in the Military Ordinariate. They will be considered equivalent to a parish priest or an assistant parish priest.

Article 26

Students of the Major Seminary of Riga and novices of Religious Congregations shall be exempted from military service and may be assigned to a community service equivalent to obligatory military service. In times of general mobilization, such students and novices will be assigned to operations which do not involve the use of weapons.

Article 27

According to canonical norms, those falling under the jurisdiction of the Military Ordinariate are the following:
(a) Catholic military and civilian personnel of the National Armed Forces of the Republic of Latvia;
(b) the members of their families: spouses and children, including adult children, if they are Catholic and form part of the same household.

Article 28

1. Chaplains and their assistants, subject to the canonical authority of the Military Ordinary, shall exercise their pastoral service in accordance with the regulations concerning the times and places for pastoral activities and other general conditions issued by the authorities of the National Armed Forces.
2. The Military Ordinariate shall co-ordinate its activities with the Ministry of Defence.

Article 29

The Ministry of Defence will provide material assistance to the personnel of the Military Ordinariate, in accordance with the legislation of the Republic of Latvia, as well as the necessary logistical arrangements for pastoral activities.

Part IV. Religious assistance to the catholic faithful in the prisons of the Republic of Latvia

Article 30

1. In conformity with the Article 9 (c) of the present agreement, the Catholic Church has the rights to offer religious assistance to Catholics in prison and other similar institutions of lawful detention.
2. In accordance with the laws of the Republic of Latvia and the norms of Canon Law, the competent authority shall guarantee to prisoners the right to appropriate religious assistance.

Part V. Final provisions

Article 31

1. The Republic of Latvia and the Holy See shall resolve by common accord and through diplomatic means every doubt or difficulty which may arise in the interpretation or application of the present Agreement.
2. The details of certain specific aspects of this Agreement will be regulated by special documents of understanding between the competent authorities of the Republic of Latvia and those of the Catholic Church.

Article 32

If the Republic of Latvia and the Holy See were to judge certain modifications to be necessary, on the account of some significant changes in the circumstances prevailing at the time of this Agreement, negotiations shall be duly initiated by representatives of the Latvian Government on the one hand and the Apostolic Nuncio on the other.

Article 33

The present Agreement is subject to ratification according to the proper constitutional and procedural norms of the Republic of Latvia and the Holy See, and shall enter into force on the date of the exchange of the instruments of ratification.
Signed on eight November 2000, in duplicate in Latvian and English, both texts being equally authentic. In case of a different interpretation, the English text shall prevail.
