Article 1

Tous ceux qui se trouvent aux Pays-Bas sont, dans des cas égaux, traités de façon égale.
Nulle discrimination n’est autorisée, qu’elle se fonde sur la religion, les convictions, les opinions politiques, la race, le sexe ou tout autre motif.

Article 6

1. Toute personne a le droit de manifester librement sa religion ou ses convictions, individuellement ou collectivement, sous réserve de la responsabilité de chacun selon la loi.
2. En ce qui concerne l’exercice de ce droit en dehors des bâtiments et des lieux fermés, la loi peut fixer des règles en vue de la protection de la santé, dans l’intérêt de la circulation et pour combattre ou prévenir les désordres.

Article 23

1. L’enseignement fait l’objet de l’attention permanente du gouvernement.
2. L’enseignement est dispensé librement, sous réserve de la surveillance des pouvoirs publics et, en ce qui concerne les formes d’enseignement spécifiées par la loi, de l’examen de la compétence et de la moralité des enseignants, le tout devant être régi par la loi.
3. L’enseignement public est régi par la loi, dans le respect de la religion ou des convictions de chacun.
4. Dans chaque commune et dans chacune des entités publiques visées à l’article 132a, un enseignement public primaire de formation générale satisfaisant est assuré par les pouvoirs publics dans un nombre suffisant d’écoles publiques. Une dérogation à cette disposition peut être autorisée selon des règles à fixer par la loi, à condition que soit fournie la possibilité de recevoir un tel enseignement, que ce soit ou non dans une école publique.
5. Les conditions de qualité que doit remplir l’enseignement financé entièrement ou en partie par des fonds publics sont fixées par la loi, en tenant compte, en ce qui concerne l’enseignement privé, de la liberté de tendance.
6. Pour l’enseignement primaire de formation générale, ces conditions sont fixées de manière à ce que la qualité de l’enseignement privé financé entièrement par des fonds publics et celle de l’enseignement public soient garanties aussi efficacement l’une que l’autre. Cette réglementation respecte en particulier la liberté de l’enseignement privé quant au choix du matériel éducatif et à la nomination des enseignants.
7. L’enseignement privé primaire de formation générale qui satisfait aux conditions posées par la loi est financé par des fonds publics sur la même base que l’enseignement public. La loi établit les conditions selon lesquelles les financements publics sont accordés à l’enseignement privé secondaire de formation générale et à l’enseignement privé pré-universitaire.
8. Le Gouvernement présente chaque année au parlement un rapport sur la situation de l’enseignement.

Article 99

La loi régit l’exemption du service militaire pour objections de conscience sérieuses.

Article 1

All persons in the Netherlands shall be treated equally in equal circumstances. Discrimination on the grounds of religion, belief, political opinion, race or sex or on any other grounds whatsoever shall not be permitted.

Article 6

1. Everyone shall have the right to profess freely his religion or belief, either individually or in community with others, without prejudice to his responsibility under the law.
2. Rules concerning the exercise of this right other than in buildings and enclosed places may be laid down by Act of Parliament for the protection of health, in the interest of traffic and to combat or prevent disorders.

Article 23

1. Education shall be the constant concern of the Government.
2. All persons shall be free to provide education, without prejudice to the authorities’ right of supervision and, with regard to forms of education designated by law, their right to examine the competence and moral integrity of teachers, to be regulated by Act of Parliament.
3. Education provided by public authorities shall be regulated by Act of Parliament, paying due respect to everyone’s religion or belief.
4. The authorities shall ensure that primary education is provided in a sufficient number of public-authority schools in every municipality and in each of the public bodies referred to in Article 132a. Deviations from this provision may be permitted under rules to be established by Act of Parliament on condition that there is opportunity to receive the said form of education, whether in a public-authority school or otherwise.
5. The standards required of schools financed either in part or in full from public funds shall be regulated by Act of Parliament, with due regard, in the case of private schools, to the freedom to provide education according to religious or other belief.
6. The requirements for primary education shall be such that the standards both of private schools fully financed from public funds and of public-authority schools are fully guaranteed. The relevant provisions shall respect in particular the freedom of private schools to choose their teaching aids and to appoint teachers as they see fit.
7. Private primary schools that satisfy the conditions laid down by Act of Parliament shall be financed from public funds according to the same standards as public-authority schools. The conditions under which private secondary education and pre-university education shall receive contributions from public funds shall be laid down by Act of Parliament.
8. The Government shall submit annual reports on the state of education to the States General.

Article 99

Exemption from military service because of serious conscientious objections shall be regulated by Act of Parliament.

Artikel 1

Allen die zich in Nederland bevinden, worden in gelijke gevallen gelijk behandeld. Discriminatie wegens godsdienst, levensovertuiging, politieke gezindheid, ras, geslacht of op welke grond dan ook, is niet toegestaan.

Artikel 6

1. Ieder heeft het recht zijn godsdienst of levensovertuiging, individueel of in gemeenschap met anderen, vrij te belijden, behoudens ieders verantwoordelijkheid volgens de wet.
2. De wet kan ter zake van de uitoefening van dit recht buiten gebouwen en besloten plaatsen regels stellen ter bescherming van de gezondheid, in het belang van het verkeer en ter bestrijding of voorkoming van wanordelijkheden.

Artikel 23

1. Het onderwijs is een voorwerp van de aanhoudende zorg der regering.
2. Het geven van onderwijs is vrij, behoudens het toezicht van de overheid en, voor wat bij de wet aangewezen vormen van onderwijs betreft, het onderzoek naar de bekwaamheid en de zedelijkheid van hen die onderwijs geven, een en ander bij de wet te regelen.
3. Het openbaar onderwijs wordt, met eerbiediging van ieders godsdienst of levensovertuiging, bij de wet geregeld.
4. In elke gemeente en in elk van de openbare lichamen, bedoeld in artikel 132a, wordt van overheidswege voldoend openbaar algemeen vormend lager onderwijs gegeven in een genoegzaam aantal openbare scholen. Volgens bij de wet te stellen regels kan afwijking van deze bepaling worden toegelaten, mits tot het ontvangen van zodanig onderwijs gelegenheid wordt gegeven, al dan niet in een openbare school.
5. De eisen van deugdelijkheid, aan het geheel of ten dele uit de openbare kas te bekostigen onderwijs te stellen, worden bij de wet geregeld, met inachtneming, voor zover het bijzonder onderwijs betreft, van de vrijheid van richting.
6. Deze eisen worden voor het algemeen vormend lager onderwijs zodanig geregeld, dat de deugdelijkheid van het geheel uit de openbare kas bekostigd bijzonder onderwijs en van het openbaar onderwijs even afdoende wordt gewaarborgd. Bij die regeling wordt met name de vrijheid van het bijzonder onderwijs betreffende de keuze der leermiddelen en de aanstelling der onderwijzers geëerbiedigd.
7. Het bijzonder algemeen vormend lager onderwijs, dat aan de bij de wet te stellen voorwaarden voldoet, wordt naar dezelfde maatstaf als het openbaar onderwijs uit de openbare kas bekostigd. De wet stelt de voorwaarden vast, waarop voor het bijzonder algemeen vormend middelbaar en voorbereidend hoger onderwijs bijdragen uit de openbare kas worden verleend.
8. De regering doet jaarlijks van de staat van het onderwijs verslag aan de Staten-Generaal.

Artikel 99

De wet regelt vrijstelling van militaire dienst wegens ernstige gewetensbezwaren.
